1. Acceptance of Terms
By requesting, scheduling, or receiving any services from On-Site Equipment Repair LLC ("we," "us," "our"), you ("customer," "you") agree to these Terms & Conditions in full. If you do not agree, do not use our services.
- You must be at least 18 years of age or an authorized representative of a business entity to engage our services.
- We reserve the right to refuse service to anyone at our sole discretion, including but not limited to situations where work conditions are unsafe, equipment is beyond economical repair, or payment history is delinquent.
- Pricing errors, whether verbal, written, or electronic, do not obligate us to perform work at the incorrect price. We will notify you of any corrections before proceeding.
2. Services We Provide
On-Site Equipment Repair LLC provides professional repair, maintenance, and inspection services for aerial lifts and heavy equipment. Our core services include:
- Hydraulic system repair — cylinders, pumps, valves, hoses, and complete hydraulic system diagnostics and overhaul.
- Electrical system repair — wiring, control boards, sensors, batteries, chargers, and electrical diagnostics.
- Drivetrain repair — motors, gearboxes, axles, brakes, wheels, and drive system components.
- Annual inspections — ANSI/OSHA-compliant annual inspections with documentation and certification stickers.
- On-site service — we come to your jobsite or facility anywhere in Texas.
- Emergency 24/7 service — after-hours and weekend emergency repairs to minimize your downtime.
- OEM parts supply — authorized parts for JLG, Genie, and SkyJack equipment.
Services are available throughout the State of Texas. Specific service availability may vary by location and equipment type.
3. On-Site Service Terms
When we come to your location, we need your help to make the job safe and efficient. The customer is responsible for providing:
- A safe work area that is free from active hazards, overhead obstructions, and unauthorized foot traffic during repair.
- Level, stable ground suitable for safely supporting the equipment during service and testing.
- Clear access to the equipment with adequate space for our service vehicle and tools.
- Electrical power if needed for diagnostics, battery charging, or tool operation (110V/20A minimum unless otherwise arranged).
The customer is solely responsible for existing site conditions, including but not limited to ground stability, environmental hazards, overhead power lines, and confined spaces. On-Site Equipment Repair LLC is not liable for hazards arising from site conditions that were not disclosed or were beyond our reasonable ability to identify upon arrival.
4. Estimates & Work Authorization
- Estimates are provided in good faith based on initial diagnosis but are not binding. Actual costs may vary once equipment is disassembled and the full scope of work is determined.
- All work must be authorized by the equipment owner or their authorized representative before we proceed. We will obtain written or electronic approval when practical.
- If additional issues are discovered during repair, we will notify you and obtain approval before performing additional work, unless the additional cost is under $250 and is necessary to complete the originally authorized repair.
- For emergency service calls, verbal authorization (including by phone) is accepted and constitutes binding approval of the work and associated charges.
5. Parts & Components
- We use OEM (Original Equipment Manufacturer) parts from JLG, Genie, and SkyJack as an authorized service provider. OEM parts carry the manufacturer's warranty.
- When aftermarket or refurbished parts are used, this will be disclosed to you in advance and noted on the invoice. Aftermarket parts carry only the aftermarket manufacturer's warranty, not OEM warranty.
- If you supply your own parts, we will install them at your request, but they are used at your own risk. We do not warranty customer-supplied parts or any failure resulting from their use.
- Parts availability is not guaranteed. Supply chain delays, manufacturer backorders, and discontinued parts may affect repair timelines. We will communicate any delays promptly.
6. Annual Inspections
- Annual inspections are performed in accordance with applicable ANSI/SIA and OSHA standards for aerial work platforms and related equipment.
- Upon passing inspection, equipment receives a current inspection sticker and supporting documentation verifying the inspection was completed.
- Inspection certification is valid as of the date of inspection only. It reflects the condition of the equipment at that specific point in time.
- Ongoing compliance is the customer's responsibility. This includes regular pre-operation checks, operator training, proper use, scheduled maintenance, and adherence to manufacturer guidelines.
- We are not liable if equipment fails inspection or becomes non-compliant after the inspection date due to use, abuse, neglect, modification, damage, or failure to perform routine maintenance.
7. Payments & Refunds
- Payment is due upon completion of services unless other arrangements have been made in writing.
- Approved commercial accounts may receive Net 30 terms subject to credit approval. Net 30 terms may be revoked at any time for late payment.
- Past-due invoices are subject to a late interest charge of 1.5% per month (18% annually) on the outstanding balance.
- Labor charges are non-refundable. Once work has been performed, labor fees are earned and non-returnable regardless of outcome.
- Parts may be returned within 30 days if unused, uninstalled, and in original packaging. A restocking fee of up to 25% may apply. Special-order and electrical parts are non-returnable.
8. Equipment Liability
- We are not liable for equipment failure that occurs after repair is completed. Equipment is complex machinery subject to wear, environmental conditions, and operator use.
- Pre-existing conditions — we are not responsible for pre-existing damage, wear, or defects that were present before our service, whether known or unknown at the time of repair.
- The customer is responsible for disclosing all known issues, history, prior repairs, and relevant information about the equipment before work begins. Failure to disclose may void any warranty on our work.
- Some repairs may involve risk of incidental damage inherent to the repair process (e.g., removing seized bolts, disassembling corroded assemblies). We exercise professional care, but we are not liable for damage that is a normal consequence of the repair procedure.
9. Emergency Service
- We offer 24/7 emergency service on a best-effort basis. We strive to respond as quickly as possible, but emergency calls are subject to technician availability.
- After-hours rates apply for service requested outside regular business hours (Monday–Friday, 8 AM–5 PM). This includes evenings, weekends, and holidays. After-hours rates will be communicated before dispatch.
- Response time estimates are good-faith approximations, not guarantees. Actual response times may vary.
- Weather, distance, road conditions, and technician workload may affect response times and availability. We will keep you informed of any delays.
10. Limitation of Liability
Please read this section carefully. It limits our financial liability to you.
- All services are provided "AS IS" to the fullest extent permitted by law. We make no warranties, express or implied, beyond what is explicitly stated in writing on your invoice or work order.
- Our total liability for any claim arising from our services is limited to the lesser of the invoice amount for the specific service at issue or $500.00.
- We are not liable for any consequential, incidental, or indirect damages, including but not limited to: lost production time, lost revenue, cost of substitute or rental equipment, project delays, contract penalties, or any other economic losses.
- Any claim must be brought within one (1) year from the date of the service giving rise to the claim.
- Force majeure — we are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, power outages, supply chain disruptions, parts shortages, manufacturer delays, pandemics, government actions, or labor disputes.
11. Premises & Shop Safety
Our shop and service areas involve heavy equipment, industrial hazards, and active repair operations. When visiting our facility or when we are working on your equipment:
- Hazards include but are not limited to: heavy machinery, hydraulic fluid under pressure, electrical systems, overhead lifts, moving parts, hot surfaces, and sharp edges.
- Personal protective equipment (PPE) including safety glasses, steel-toe boots, and hearing protection is strongly recommended for anyone entering the shop or service area.
- No children or minors are permitted in the shop or active service areas at any time.
- Personal property left in or on equipment is the customer's responsibility. We are not liable for damage to or loss of personal items.
- Our facility may have video surveillance for security and quality assurance purposes. By entering the premises, you consent to being recorded.
- Equipment stored at our facility is held at the customer's risk. We will exercise reasonable care, but we require 48 hours' notice before pickup of completed equipment.
12. Indemnification
You agree to indemnify, defend, and hold harmless On-Site Equipment Repair LLC, its owners, employees, and contractors from any and all claims, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:
- The condition of your equipment, including pre-existing defects, undisclosed damage, or hazardous conditions of the equipment itself.
- Site conditions at customer locations where on-site service is performed, including hazards not disclosed or not reasonably discoverable by our technicians.
- Any third-party claims arising from the use of equipment after our service has been completed.
- Operator error, misuse, or negligence occurring after repair, maintenance, or inspection has been completed.
This indemnification obligation survives the termination of any service agreement or business relationship between the parties.
13. Waiver of Claims
By engaging our services, you voluntarily and knowingly waive, release, and forever discharge On-Site Equipment Repair LLC, its owners, employees, and contractors from any and all claims, demands, actions, causes of action, and liabilities, whether known or unknown, that arise from or relate to our services, except in cases of willful misconduct or gross negligence.
This waiver is binding upon you, your heirs, successors, assigns, and legal representatives.
14. Dispute Resolution
- These terms are governed by and construed in accordance with the laws of the State of Texas. Any legal proceedings shall be brought exclusively in the courts of Montgomery County, Texas.
- Before filing any formal legal action, both parties agree to attempt informal resolution through good-faith negotiation for at least 30 days after written notice of the dispute.
- If informal resolution fails, disputes shall be resolved through binding arbitration conducted in Montgomery County, Texas, under the rules of the American Arbitration Association.
- Both parties waive the right to a jury trial for any dispute arising under these terms.
- Both parties waive the right to participate in a class action or class-wide arbitration. All claims must be brought individually.
15. Privacy
We collect only the information necessary to perform our services and communicate with you (name, contact information, equipment details, service history). We will never sell, rent, or share your personal data with third parties for marketing purposes. Your information is used solely for service delivery, invoicing, and direct communication with you.
16. General Provisions
- Severability — If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- Entire Agreement — These terms, together with any written work order or invoice, constitute the entire agreement between you and On-Site Equipment Repair LLC regarding the services provided. They supersede all prior or contemporaneous oral or written agreements.
- No Waiver — Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future.
- Assignment — You may not assign your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to a successor entity.
- Changes — We reserve the right to update these terms at any time. Changes take effect when posted to this page. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
